Terms of Service

Welcome to BlossomEV, a platform that facilitates transactions between hosts and guests for EV charging sessions. By accessing or using our platform, you agree to be bound by these terms of service (“Terms”). Please read them carefully before using the platform.

  1. Definitions
    • “Platform” refers to our website and any related software, services, or tools.
    • “Host” refers to any individual or entity that offers an EV charging station for use by Guests.
    • “Guest” refers to any individual or entity that seeks to schedule an EV charging session on the platform.
    • “Transaction” refers to any interaction between a Host and a Guest facilitated by the platform.
    • “EV” refers to an electric vehicle.
  2. Use of the Platform
    • You must be 18 years or older to use the platform.
    • You agree to provide accurate and complete information when registering for an account.
    • You are solely responsible for maintaining the confidentiality of your account and password.
    • You are responsible for all activities that occur under your account.
    • You agree to use the platform only for lawful purposes and in compliance with all applicable laws and regulations.
  3. Fees
    • Hosts will be compensated for use of their chargers according to the cost of energy
    • consumed by the guest plus a service fee.
    • Guests pay a fee to schedule an EV charging session on the platform.
    • BlossomEV charges a small fee to the guest for facilitating the transaction between the host and guest.
  4. Transactions
    • Hosts and Guests are solely responsible for negotiating and agreeing on the terms of a Transaction.
    • The platform does not guarantee the quality, accuracy, or safety of any EV charging stations offered by Hosts.
    • The platform is not responsible for any disputes between Hosts and Guests.
    • The platform reserves the right to remove any Host or Guest from the platform for any reason.
  5. Booking and Payment
    • Guests may schedule EV charging sessions on the platform.
    • Hosts will receive notification of the scheduled EV charging session and must confirm the booking within a set timeframe.
    • Guests must pay for the EV charging session in advance using the platform’s payment system.
    • Payments will be held in escrow by the platform until the completion of the EV charging session.
    • Hosts will receive payment for the completed EV charging session after deducting the cost of energy consumed by the guest and the service fee.
  6. Feedback
    • Guests are required to provide feedback to the Host after each completed EV charging session.
    • The feedback provided by the Guest will be public.
    • We reserve the right to remove any feedback that is offensive, false, or violates these Terms.
  7. Intellectual Property
    • The platform and its contents are protected by copyright, trademark, and other laws.
    • You may not copy, modify, distribute, or otherwise use any content from the platform without our prior written consent.
  8. Disclaimer of Warranties
    • The platform is provided on an “as is” and “as available” basis.
    • We do not make any warranties, express or implied, regarding the platform, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement.
    • We do not guarantee that the platform will be error-free or uninterrupted.
  9. Limitation of Liability
    • We will not be liable for any damages, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use or inability to use the platform, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses.
    • Our total liability for any claim arising out of or in connection with the use of the platform will not exceed the amount paid by the Guest for use of the platform.
  10. Indemnification
    • You agree to indemnify, defend, and hold harmless BlossomEV and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the platform.
  11. Governing Law and Jurisdiction
    • These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, without giving effect to any principles of conflicts of law.
    • Any dispute arising out of or in connection with these Terms shall be resolved exclusively through arbitration in accordance with the rules of the Canadian Arbitration Association.
  12. Changes to the Terms
    • We reserve the right to modify or update these Terms at any time without prior notice.
    • Your continued use of the platform after any changes to the Terms shall constitute your acceptance of such changes.
  13. Termination
    • We may terminate your access to the platform at any time for any reason.
    • Upon termination, you agree to immediately cease using the platform and destroy all materials obtained from the platform.
  14. Miscellaneous
    • These Terms constitute the entire agreement between you and BlossomEV with respect to the platform.
    • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    • Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
    • You may not assign these Terms or any rights or obligations hereunder, whether by operation of law or otherwise, without our prior written consent.
